Amendments 3 and 7 Still In Tact!
As far as I can tell, Amendments 3 and 7 of the Bill of Rights are still in tact. They seem to have survived 4 and 1/2 years of the present administration. I often point out the short comings of US government and rarely give applause to what is still right. While the other 8 Amendments to The Constitution have been all but abolished, today we celebrate 3 and 7.
Amendment III
No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.
Amendment VII
In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.
Let’s enjoy them while they last. This administration still has 3 1/2 more years to completely eradicate The Bill of Rights. As for the other 8, let us take a moment to remember them as they once were.
Amendment I
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
I am sure we are all aware that this Amendment is no longer enforced. The recent wire taping and e-mail hacking by the DOJ ensures that the press will always fear the government and stay in line. Likewise, groups using words like “Constitution”, “Tea Party”, and “Patriot”. have been targeted by the IRS as a means of intimidation. King George must be rolling in his grave. Had he known the American people would be intimidated so easily, he could have focused more on France.
Amendment II
A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.
While falling far short of her goal of banning all weapons of every sort except those used to police, temporizer and suppress a free people, Diane Fienstien can be proud that her rhetoric helped Andrew Cuomo ban most modern pistols in the state of New York. The NY 7 round magazine limit effectively banned most all types of semiautomatic pistols. Most manufacturers of these pistols do not make 7 round magazines. This law renders them unusable.
Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
In case you missed the video footage of the search for the Boston bombing suspect on YouTube, here is a link to a video featuring US citizens being dragged from their homes at gun point, then led down the street to be frisked like criminals. Of course it was not covered by the mainstream media because they are to scared of the DOJ.
Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.
Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
The 2012 National Defense Authorization Act contained a provision that allows the government to arrest a US citizen without charging them and to detain them indefinitely without bail. This provision directly violates Amendments IV,V, VI, and VIII.
Amendment IX
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
Not only have those right not enumerated been trampled under foot by an ever growing all consuming government, but those that were specifically granted have been tossed out the window while we have enjoyed our bread and circuses.
Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
The federal government has assumed power never intended for itself. It has taken the place of state government in the arena of education and made a mess of the entire system. It has intruded into the business of the Church and turned charity into a means of purchasing votes through social welfare programs. It has set itself as master and will force us to purchase health insurance by the barrel of a gun. If you think I am being over dramatic about health care, try not purchasing the mandated policy, then try not paying the fine imposed by the IRS. See how long it takes before you are staring down the barrel of a gun.
The author of the Declaration of Independence, Thomas Jefferson said ”
“When the people fear the government there is tyranny, when the government fears the people there is liberty.”
If you are not mad, you are not paying attention.

Actually, the III and VII are not intact:
III – The Executive Orders declaring everything from personal property to transportation to food to the internet under martial law…which can be declared for whatever is deemed an emergency, if there even is one. Imminent Domain means the government can take your whole house and land for the greater good. In the past Supreme Court decision this means a shopping mall pays more taxes than you so your right of personal property is gone!
VII – NDAA means indefinite suspension of you and your rights. No trial by jury or legal counsel. The Writ of Habeas Corpus no longer applies to you. Due to you being deemed a national security threat this would apply to civil and criminal cases I imagine. Hundreds of thousands of National Security Letters have been sent out, most with complete gag orders. A federal judge blocked their use but the DOJ/FBI has stated that they will continue to use them anyway!
Also:
Amendment I – You forgot “Free Speech Zones.” Also H.R. 347 which states you cannot protest anyone under secret service protection. That can be anyone the President deems necessary. The latest is a FELONY for speaking against another person’s religion. The was in the past few days. Hate Speech makes unequal classes of citizens and favors minorities which are rarely prosecuted for hate speech against majorities.
The government’s job, per the Declaration of Independence, is to protect the rights of the people (not to make them safe as that is the opposite of Liberty). When they don’t and also do not follow the Constitution, we have Tyranny!
